Criminal Injuries Compensation - the victim of an assault
can either make a claim against the person responsible for the assault or make
a claim to the
Criminal Injuries Compensation Authority based in Glasgow.
If you fall within the terms of the CICA scheme, co-operated fully with the
police and your own conduct before, during or after the incident is not called
into question then the CICA can make an award of compensation based on a tariff.
Each type of injury has a specific award. |
| It is important to note that whereas normal compensation claims for injury have a three year time limit, a claim to the CICA has to be submitted to them within 2 years of the date of the incident. Different rules apply in relation to claims by children and people who are, or were suffering from a mental disability which prevented them from making the claim any earlier. The CICA have the power to override the time limit if there is a very good reason but the sooner these claims are submitted the better because they can take a significant amount of time to be dealt with. |
