Medical Negligence

Medical Negligence - we act for a significant number of clients who contend that they have been the victims of medical negligence. To succeed with a claim against a doctor (or indeed any other professional person in Scotland) you have to overcome the basic professional negligence test by proving 4 things:-

1. What the normal practice should have been in dealing with your particular situation.
2. That the professional in question has not followed the normal practice
3. That no reasonably competent professional of the type in question would have departed from normal practice and
4. That a loss has been caused to you as a result of them not following normal practice.

It can be a difficult test to overcome and invariably requires the input of an independent expert to consider any relevant documentation and write a report on the issues of negligence. Unfortunately, because of the difficulties associated with medical and professional negligence claims we do not undertake this work on a no win no fee basis although legal aid may be available.
